| Court: Pets, owner not to be reunited - msnbc.com Posted: 23 Dec 2010 03:46 AM PST Levittown — The pets that a woman poisoned last summer at the same time she tried to kill herself will go to the SPCA. Montgomery County Judge Steven T. O'Neill Wednesday rejected a request by Linda Muchnick, 57, formerly of Towamencin, to return the 16 surviving cats and dog to her. "I am very pleased with the outcome," said Assistant District Attorney Abby Silverman, who argued against Muchnick's petition. Silverman, who said the SPCA has spent $32,333 in caring for the animals since Muchnick was taken into custody, can now "re-home" the pets. However, Muchnick said she intends to continue with her efforts to get "my family members back" and will appeal O'Neill's ruling. "No one other than Jesus has lived a life without making mistakes," said Muchnick. "I still love my babies." Muchnick, overwhelmed by financial problems and about to be evicted from her residence in Towamencin, on Aug. 20, 2009, attempted to kill herself and her 30 cats and a dog, lacing their food with rat poison. She left behind a suicide note that stated, in part, that it would be best for her pets if they died with her "so they could be in heaven together," according to the criminal complaint. Fourteen of the cats died while the remaining animals were taken to an SPCA shelter. Muchnick was devastated to learn that, while she had survived her suicide attempt, about half of her pets had died, according to a psychiatrist who interviewed Muchnick after her arrest. Less than two weeks after she was found not guilty on animal cruelty charges by reason of insanity, Muchnick petitioned the court to have her surviving pets returned to her. In that petition, Muchnick said she now has an income to care for the pets and a support system in place to help her with any problems. "The animals should be turned over to the SPCA for placement because of the ordeal they suffered at her hands," said Silverman. Also, Muchnick is living in a one bedroom apartment in Pottstown and adding 16 pets to that living arrangement "is probably a situation that again could drive her to desperate acts," said Silverman.
